Privacy Policy

MB Bank (Cambodia) Plc. (the “Bank”) is committed to ensuring the confidentiality of customer’s information within the scope of the Bank's management. The customer’s personal information will be stored and secured in accordance with the provisions of law relating to the storage of personally identifiable information. All customer’s personal information is protected by the Bank, avoiding any unauthorized access from any third party.

The Bank recognizes the expectations of its customers with regard to privacy, confidentiality and security of their personal information that resides with the Bank. Keeping personal information of customers secure and using it solely for activities related to the Bank and preventing any misuse thereof is a top priority of the Bank. The Bank has adopted the privacy policy aimed at protecting the personal information entrusted and disclosed by the customers [“the Policy”]. This Policy governs the way in which the Bank collects, uses, discloses, stores, secures and disposes of personal information and sensitive personal data or information.

1. Terms and Definition
• “Personal Information” means any information that relates to a natural person, which either directly or indirectly, in combination with other information available or likely to be available with the Bank, is capable of identifying such person.
• “Sensitive personal data or information” of a person means such personal information which consists of information relating to password, financial information, biometric information and any other defined by applicable laws.

2. Scope of Policy
This Policy is applicable to personal information and sensitive personal data or information collected by the Bank or its affiliates directly from the customer or through the Bank’s website, online portals, mobile apps and electronic communications as also any information collected by the Bank’s server from the customer’s browser.

3. Purpose of Collection and Use of Personal Information
The Bank collects and uses the financial information and other personal information from its customers. This information is collected and used for specific business purposes or for other related purposes designated by the Bank or for a lawful purpose to comply with the applicable laws and regulations. The Bank shall not divulge any personal information collected from the customers, for cross selling or any other purposes.
The authenticity of the personal information provided by the customer shall not be the responsibility of the Bank. Any information that is freely available or accessible in public domain or furnished under any relevant law for the time being in force shall not be regarded as personal information for purposes of this Policy and the Bank shall not be responsible for the same.

4. How Do We Collect the Customer’s Personal Information?
We collect the customer’s personal information directly from the customer when the customer:
- Interact with us over the website,
- Interact with us online or digital platform,
- Participate in surveys or questionnaires,
- Attend our Bank’s event;
- Subscribe to our mailing list.

5. Customer’s Consent to Collection, Use and Disclosure
We collect, use and disclose the customer’s personal information with his/her content or as permitted or required by Cambodian Laws and Regulations. How we obtain the customer’s consent (i.e., the form we use) will depend on the circumstances, as well as the sensitivity of the information collected. Subject to applicable laws, the customer’s consent may be express or implied, depending on the circumstances and the sensitivity of the personal information in question.
If customer choose to provider personal information to us, we assume that his/her consent to the collection, use and disclosure of that personal information as outlined in this Privacy Policy.
If the customer provides personal information about another individual to us, it is the customer’s responsibility to obtain the consent of that individual to enable us to collect, use and disclose his or her information as describe in this Privacy Policy.

6. Children’s Information
The Bank does not seek nor will the Bank knowingly collect personal information from anyone under the age of 18. The Website content and services are intended for users over the age of 18. Children under the age of 18 should not use our Products and Services and should not provide us with their personal information.

7. Disclosure of Personal Information
The personal information collected by the Bank shall not be disclosed to any other organization except:
1- Where the disclosure has been agreed in a written contract or otherwise between the Bank and the customer;
2- Where the Bank is required to disclose the personal information to a third party on a need-to-know basis, provided that in such case the Bank shall inform such third party of the confidential nature of the personal information and shall keep the same standards of information/data security as that of the Bank.
3- Where the Bank is required to disclose by law or in response to valid requests by public authorities (e.g., a court or the Bank’s supervisor).

8. Security Method
• All information sent to the Bank via the website is protected by encryption technology to ensure that customer information is maximally protected during transmission.
• The Bank will take all reasonable measures to ensure the safety of the Customer personal information and always comply with Cambodian laws regarding the storage and use of information.

9. Retention of Personal Information
We have personal information retention processes designated to retain the customer’s personal information for no longer than necessary to fulfill the purposes of which that personal information was collected and as otherwise required by applicable laws.

10. Cookie Policy
The Bank’s digital platforms use various third party analytical tools. These tools use cookies which are downloaded to the customer’s device when he/she visit a website in order to provide a personalized browsing experience. Cookies are used for lots of tasks like remembering the customer’s preferences & settings, provide about how his/her users use a website, for instance, how often visited pages. All information collected by third party cookies is aggregated and anonymous. By using our website user agree that these types of cookies can be placed on his/her device. The User is free to disable/delete these cookies by changing his/her device/browser settings. The Bank is not responsible for cookies placed in the device of user by any other website and information collected thereto.
